Invitation for Bid

Notice is hereby given that Archuleta County will accept sealed bids for the asbestos and lead abatement and interior demolition of a building located at 398 Lewis Street, Pagosa Springs, Colorado.

THREE SETS (ONE ORIGINAL AND TWO COMPLETE COPIES OF THE SEALED BID), clearly marked with “Asbestos and Lead Abatement and Interior Demolition”, along with the name, address and telephone number of the bidder, will be received by Larry Walton, Contracts and Procurement Officer, Archuleta County Courthouse, 449 San Juan St., Pagosa Springs, CO 81147, phone (970) 264-8555, until 2:00 p.m., Friday, Feb. 21, 2014. Bids must be hand delivered, or delivered by a professional courier or delivery service (such as UPS or Fed-Ex). Mailed, faxed and emailed bids will not be accepted. Late submittals will not be accepted and will be mailed back to the bidder unopened. As soon as practical after the bid closing time, all bids shall be opened in public and read aloud.

An Optional site walk-thru will be conducted on Thursday, Feb. 13, 2014 at 10:00 a.m. The location is 398 Lewis Street, Pagosa Springs, Colorado. Bidders are encouraged to attend. There will be no additional site visits prior to the bid opening.

Bidders must obtain and follow the instructions contained in the full “Invitation for Bid” package for this project. This package is available at the Archuleta County Courthouse Finance Department Office, located at 449 San Juan Street, Pagosa Springs, CO 81147. It may also be viewed and/or downloaded from the County website at the following URL: http://co-archuletacounty.civicplus.com/bids.aspx, or by requesting a copy from Larry Walton, Contracts & Procurement Officer by email: lwalton@archuletacounty.org. Answers to all questions, inquiries, or requests for additional information will be issued in the form of addendum to the IFB. The County will not be responsible for the authenticity or correctness of oral interpretations of the contract documents or for information obtained in any other manner than through the media of addenda. Bidders in their bids shall acknowledge receipt of each addendum, and each addendum shall be considered a part of the contract documents. Failure to acknowledge receipt of an addendum issued may invalidate a bid as incomplete. Questions must be received no later than 4:00 pm, Feb. 18, 2014.

All bidders must supply information about the Qualifications and Experience of their firm and any subs used to perform the required work. The County intends to use this information to “short list” appropriately qualified and experienced bidders, and then the Board of County Commissioners will make an award to the low bid from that short list. It is the Bidders’ responsibility to verify the exact date of the award. Bidders may, but shall not be required to, attend the award of bid. A bid tab shall be forwarded to all Bidders as soon as practicable thereafter.

The Archuleta County Board of County Commissioners reserves the right to reject any and all bids, to waive any informalities and minor irregularities in bids, and to accept the bid deemed, in the opinion of the Board, to be in the best interest of Archuleta County.

AN ORDINANCE SUBMITTING TO THE REGISTERED ELECTORS OF THE TOWN OF PAGOSA SPRINGS THE QUESTION OF AMENDING ARTICLE 6, SECTION 6.2 OF THE HOME RULE CHARTER OF THE TOWN OF PAGOSA SPRINGS

REGARDING THE POWERS OF THE 

TOWN OF PAGOSA SPRINGS MUNICIPAL COURT

WHEREAS, the Town of Pagosa Springs (“Town”) is a home rule municipality duly organized and existing under Article XX of the Colorado Constitution and the Pagosa Springs Home Rule Charter of 2003, as amended(“Charter”); and

WHEREAS, Article 6, Section 6.2 of the Town Code grants jurisdiction to the municipal court to hear and try all alleged violations of the Town’s ordinances; and

WHEREAS, Article 12, Section 12.2 of the Charter states that the Charter may be amended in the manner provided in the Colorado Constitution and Title 31, Article 2 of the Colorado Revised Statutes, and that proceedings to amend the Charter may be initiated by the filing of a petition meeting the requirements of the Colorado Revised Statutes, or by the adoption of an ordinance by Town Council submitting the proposed amendment to a vote of the registered electors of the Town; and

WHEREAS, the Town Council hereby finds and determines that the submittal of an amendment to the Charter to expand the jurisdiction to the municipal court to hear and try all matters arising under the Town Charter, the Town ordinances, and other enactments of the Town, is appropriate and necessary to the function and operation of the Town.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PAGOSA SPRINGS, COLORADO, as follows:

Section 1. Town Charter Amendment. Pursuant to Section 31-2-210(4), C.R.S., notice is hereby given to the registered electors of the Town of Pagosa Springs that the following proposed amendment to Title 6 of the Charter, amending Section 6.12 by adding the capitalized and double-underlined words, will be submitted to the registered electors at the regular municipal election to be held on April 8, 2014, pursuant to Ordinance No. 801 (Series 2014):

ARTICLE 6

TOWN ATTORNEY AND MUNICIPAL COURT

Section 6.2 Municipal Court

There shall be a Municipal Court, which shall have jurisdiction to hear and try all MATTERS ARISING UNDER THIS CHARTER, THE TOWN ORDINANCES AND OTHER ENACTMENTS OF THE TOWN. The Municipal Court shall have all jurisdiction as is provided under State statutes and rules promulgated by the Colorado Supreme Court. The Municipal Court shall be a qualified Municipal Court of Record and shall keep a verbatim record of all proceedings and evidence at trials by either electronic or stenographic means.

Section 2. Ballot Title. The official ballot shall contain the ballot title which shall also be the designation and submission clause for the question:

“Shall the Town of Pagosa Springs Home Rule Charter be amended to grant the municipal court authority to hear and try all matters arising under the Charter, the Town ordinances, and other enactments of the Town?”

Section 3. Election. At the regular municipal election to be held on April 8, 2014, the ballot question set forth in this Ordinance shall be submitted to the electors and the Charter shall be thereby amended if a majority of the registered electors of the Town voting thereon approve the ballot question.

Section 4. Public Inspection. The full text of this Ordinance, with any amendments, is available for public inspection at the office of the Town Clerk.

Section 5. Severability. If any portion of this Ordinance is found to be void or ineffective, it shall be deemed severed from this Ordinance and the remaining provisions shall remain valid and in full force and effect.

Section 6. Effective Date. This Ordinance shall become effective and be in force immediately upon final passage at second reading.

The Office of the DEO is open on the following days: Monday-Friday from 7:00 a.m. to 4:30 p.m.

If the DEO determines that a Self-Nomination and Acceptance form is not sufficient, the eligible elector who submitted the form may amend the form once, at any time, prior to 3:00 p.m. on Friday, February 28, 2014. The deadline to submit a Self-Nomination and Acceptance is close of business on Friday, February 28, 2014 (not less than 67 days before the election). Earlier submittal is encouraged as the deadline will not permit curing an insufficient form. Affidavit of Intent To Be A Write-In-Candidate forms must be submitted to the office of the designated election official by the close of business on Monday, March 3, 2014 (the sixty-fourth day before the election).

NOTICE IS FURTHER GIVEN, an application for a mail-in ballot shall be filed with the designated election official no later than the close of business on Friday, May 2, 2014, except that, if the applicant wishes to receive the mail-in ballot by mail, the application shall be filed no later than the close of business on Tuesday, April 29, 2014.

NOTICE IS HEREBY GIVEN that an election will be held on the 6TH day of May, 2014, between the hours of 7:00 a.m. and 7:00 p.m. At that time, 3 directors will be elected to serve 4-year terms.
