BOARD OF COUNTY COMMISSIONERS HEARING ON September 4th
Gary Devloo of Pagosa Springs and David Bouquet of Spring, TX, have applied for final plat approval of the Pagosa in the Pines Amendment 2018-01, a replat and easement vacation of Lots 27, 28, 29, 31 & 32, Block 4 of Pagosa in the Pines subdivision, creating Lots 27Z (601 Handicap Ave) and 31Z (152 Carlee Pl) (PLN18-128). The property is owned by the Gary H. Devloo Living Trust and David Bouquet, zoned Planned Unit Development (PUD) R-1-90.

APPLICATION
On June 19, 2018, Catamount Energy Partners, LLC (Operator No. 10464) (“Catamount” or “Applicant”) filed a verified application pursuant to §34-60-116, C.R.S. for an order to:
1) Vacate Order No. 112-280, which pooled all interests in the approximate 663-acre drilling and spacing unit established for the Application Lands and in the Morales 34-6-6U #2 well (API No. 05-067-09991), for the development and operation of the Fruitland Coal Seams.
APPLICABLE ORDERS AND RULES
(available online at: http://cogcc.state.co.us, under “Regulation,”
then select “Orders” or “Rules”)
• On December 9, 2008, the Commission entered Order No. 112-215, which allowed up to four wells to be drilled in each 320-acre drilling and spacing unit subject to the Order for the production of gas from the Fruitland Coal Seams, with the permitted wells to be located no closer than 660 feet from the unit boundary, with no interior section line setback. The Order further requires that the wells drilled pursuant to this Order must comply with the provisions of the MOU between BP America Production Company and La Plata County.
• On December 14, 2015, the Commission entered Order No. 112-246, which pooled all interests in the Application Lands for the development and operation of the Fruitland Coal Seams, effective as of the date of the Application, for the drilling of the Morales 34-6-7 #1 well (API No. 05-067-09972) and subjected all nonconsenting interests to the cost recovery provisions of Section 34-60-116(7), C.R.S.
• On March 19, 2018, the Commission entered Order No. 112-280, which pooled all interests in the Application Lands in the Morales 34-6-6U #2 well for the development and operation of the Fruitland Coal Seams and was made effective as of the earlier of the date of this Application, or the date costs specified in Section 34-60-116(7)(b)(II), C.R.S., are first incurred for the drilling of the Morales 34-6-6U #2 well.
NOTICE IS HEREBY GIVEN, pursuant to §§ 34-60-101 to 130, C.R.S., and the Commission’s Rules of Practice and Procedure, 2 CCR 404-1, that the Commission has scheduled this matter for hearing on:

The Town of Pagosa Springs has received a “Notice of Appeal” from Deni Blaisch of Heart to Heart Health and 2u Mobile Massage, challenging the Town of Pagosa Springs Planning Director’s final determination on the requirement to obtain a temporary use permit for operating the business from a temporary structure at 56 Talisman Drive.
The Board of Adjustments will conduct an Appeals Hearing to consider the facts and testimony as presented by the Town Planning Director and Heart to Heart Health/2u Mobile Massage regarding the Planning Director’s final determination. The Board of Adjustments may, in whole or in part, affirm, reverse, or amend the Planning Director’s determination.
The Board of Adjustments has scheduled the Appeals Hearing on Tuesday, August 28, 2018 at 5:30pm in Town Hall, however, please note this date may change without timely notice to you before the scheduled hearing, so please, if you plan on attending, call the Planning Department to confirm the hearing date.
All meetings and hearings will be conducted in Town Hall, located at 551 Hot Springs Blvd. Anyone wishing to receive more information should contact the Town Planning Department at 970-264-4151 x221.
