YOU ARE HEREBY NOTIFIED that a hearing on the Motion for Termination of Parent-Child Legal Relationship will be held at the Archuleta County District Court, 449 San Juan Street, Pagosa Springs, Colorado 81147 on March 4, 2013 at 2:30 p.m. You have the right to waive your right to appear and contest. However, failure by you to appear at the above listed hearing date will result in the termination of your parental rights to the minor child.

YOU ARE HEREBY NOTIFIED that you have a right to have an attorney represent you at the termination hearings, or you may waive the right to an attorney. If you so desire to be represented by an attorney, and you do not have one, you should begin now to obtain one and to notify the court of the attorney’s name and address. If the court finds you cannot afford to pay an attorney, and you wish one to represent you, you may be entitled to a court appointed attorney. YOU ARE FURTHER NOTIFIED that:

1. The statements in the motion must be proven by clear and convincing evidence if parental rights are to be terminated. Termination of the parent-child legal relationship means that the child who is the subject of the petition would be eligible for adoption.

2. You have a right to question any witnesses who appear and testify at the hearing. You have a right to bring with you any witnesses you wish to have testify. If you so request, the court may order persons to be present as your witness.

3. At the end of the hearing, when the court has made a decision, you have a right to request a rehearing or new trial, but your request must be made in writing within fifteen (15) days of the court’s decision, unless the court grants a longer time. If your request for rehearing is denied, you have a right to appeal the court’s decision to the Colorado Court of Appeals. You may also appeal the court’s decision directly to the Colorado Court of Appeals within 21 days from the entry of the date of the court’s order.

4. Relatives, including grandparents, aunts, uncles, brothers or sisters of the child may file a request for guardianship or legal custody of the child with this court should this motion to terminate parental rights be granted. However, any request must be filed within 20 days from the date that the motion for termination of parental rights was filed with the court.

5. An indigent parent has the right to have appointed one expert witness of his own choosing whose reasonable fees and expenses, subject to the court’s review and approval, shall be paid by the State of Colorado pursuant to section 19-3-610. All ordered evaluations shall be made available to counsel at least 15 days prior to the hearing.
