for the furnishing and installation of Improvements to the Archuleta County Airport – Stevens Field, Schedule I – Acquire Four Wheel Drive Rubber Tire Standard Production Loader with Plow Attachment, AIP Project No. 3-08-0066-21 and any person, co-partnership, association or corporation who has an unpaid lien against said power Equipment Company for or on account of the furnishing of labor, materials, team hire, sustenance, provision, provender or other supplies used or consumed by such Contractor or any of the subcontractors in or about the performance of said work, may at any time up to and including said time of final settlement on said 3rd day of March, 2014, file a verified statement in the amount due and unpaid on account of such claim with Archuleta County.

Failure on the part of the claimant to file such final statement will relieve said Owner from all and any liability for such claim.

NOTICE OF ELECTION ON PROPOSED CHARTER AMENDMENT

TOWN OF PAGOSA SPRINGS, COLORADO

ORDINANCE NO. 803

(SERIES 2014)

AN ORDINANCE SUBMITTING TO THE REGISTERED ELECTORS OF THE TOWN OF PAGOSA SPRINGS THE QUESTION OF AMENDING ARTICLE 2, SECTION 2.1 OF THE HOME RULE CHARTER OF THE TOWN OF PAGOSA SPRINGS TO PROVIDE FOR COMPENSATION FOR THE MAYOR AND OTHER MEMBERS OF TOWN COUNCIL

WHEREAS, the Town of Pagosa Springs (“Town”) is a home rule municipality duly organized and existing under Article XX of the Colorado Constitution and the Pagosa Springs Home Rule Charter of 2003, as amended (”Charter”); and

WHEREAS, Article 2, Section 2.1 of the Town Code establishes a seven member Town Council and states that Council Members shall not receive pay except by voter approval; and

WHEREAS, Article 12, Section 12.2 of the Charter states that the Charter may be amended in the manner provided in the Colorado Constitution and Title 31, Article 2 of the Colorado Revised Statutes, and that proceedings to amend the Charter may be initiated by the filing of a petition meeting the requirements of the Colorado Revised Statutes, or by the adoption of an ordinance by Town Council submitting the proposed amendment to a vote of the registered electors of the Town; and

WHEREAS, on January 2, 2014, the Town Clerk received a statement of intent to circulate a petition to amend the Charter; and

WHEREAS, on or before January 8, 2014, the Town Clerk received a petition proposing the following amendment to the Charter (the “Petition”):

“The Mayor shall be compensated for his or her services to the town in the fixed amount of $300 per month. Each Council Member shall be compensated for their services to the town in the fixed amount of $200 per month.”; and

WHEREAS, the Town Clerk has certified the validity and sufficiency of the Petition pursuant to §31-2-210(3), C.R.S.; and

WHEREAS, pursuant to Section 2.2 of the Charter and §31-2-210(3), C.R.S., the Town Council sets the ballot title for citizen-initiated amendments to the Charter.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PAGOSA SPRINGS, COLORADO, as follows:

I. Town Charter Amendment Election. Pursuant to Section 31-2-210(4), C.R.S., notice is hereby given to the registered electors of the Town of Pagosa Springs that the following proposed amendment to Title 2 of the Charter, amending Section 2.1 will be submitted to the registered electors at the regular municipal election to be held on April 8, 2014, pursuant to Ordinance No. 801 (Series 2014), and if a majority of the registered electors of the Town voting thereon approve the ballot question, such amendment shall be added to the Charter:

Section 2.1 Council Members

A) THE MAYOR SHALL BE COMPENSATED FOR HIS OR HER SERVICE TO THE TOWN IN THE FIXED AMOUNT OF $300 PER MONTH. EACH COUNCIL MEMBER SHALL BE COMPENSATED FOR THEIR SERVICES TO THE TOWN IN THE FIXED AMOUNT OF $200 PER MONTH.

II. Ballot Title. The official ballot shall contain the ballot title which shall also be the designation and submission clause for the question:

“Shall the Town of Pagosa Springs Home Rule Charter be amended to provide for compensation for the Mayor in the amount of $300 per month and compensation for all other Council Members in the amount of $200 per month?”

III. Public Inspection. The full text of this Ordinance, with any amendments, is available for public inspection at the office of the Town Clerk.

IV. Severability. If any portion of this Ordinance is found to be void or ineffective, it shall be deemed severed from this Ordinance and the remaining provisions shall remain valid and in full force and effect.

V. Effective Date. This Ordinance shall become effective and be in force immediately upon final passage at second reading.
