ORDINANCE NO. 759, AN ORDINANCE OF THE TOWN OF PAGOSA SPRINGS AMENDING PORTIONS OF CHAPTER 21 OF THE PAGOSA SPRINGS MUNICIPAL CODE, LAND USE AND DEVELOPMENT CODE, REGARDING THE INTERNATIONAL FIRE CODE, 2006 EDITION INCLUDING APPENDICES. Notice of a Finding of No Significant Impact
The USDA, Rural Utilities Service has received an application for financial assistance from Pagosa Springs Sanitation General Improvements District. The proposal consists of the replacement of the existing aerated lagoon system with a new mechanical WWTP. The new mechanical WWTP will improve ammonia-nitrogen removal efficiency to meet more stringent permitted effluent limitations, as well as increase the plant’s hydraulic and organic loading capacity. A Detailed Study (detailed topographic cross sections and flow data entered into the HEC RAS computer model) was completed to determine the Base Flood Elevations (BFE) and extent of the floodplain in that area since the BFE are not available as currently mapped in a FEMA approximate Zone A. It was found that the proposed plant development would not increase the water surface elevation of the base floodplain by more than a foot at any point within the community. This approach is consistent with both the FEMA 8 Step Process and the relevant sections of FEMA Title 44 CFR 60.3(c). The proposed WWTP may be constructed during a portion of the breeding bird season (April 1st through August 15th), resulting in greater impacts to migratory birds. If construction occurs during the breeding bird season, clearance surveys are recommended approximately seven (7) days prior to implementation to minimize any potential impacts to MBTA species. The alternatives considered to the proposal include: Alternative No. 1: Convert Current Treatment Facility into Activated Sludge Process; Alternative No. 2: Interconnecting with Other Existing Facilities; Alternative No. 3: Developing Centrally-Managed Clustered or Individual Facilities; Alternative No. 4: Cold Weather Nitrification; and Alternative No. 5: Alternate Facility Locations. Each of the alternate locations both North and South of Mill Creek would involve a pipeline crossing of the San Juan River corridor, have potential to impact wetlands, have potential impact to sensitive biological resources, would require an additional lift station, and are located farther from three phase power; therefore the alternative site locations were not considered practicable alternatives.
As required by the National Environmental Policy Act and agency regulations, the Rural Utilities Service prepared an Environmental Assessment of the proposal that assessed the potential environmental effects of the proposal and the effect the proposal may have on historic properties. The Environmental Assessment was published on October 28, 2010 and November 4, 2010 for a 30-day public comment period. No comments were received.
Upon consideration of the applicant’s proposal, federal and state environmental regulatory and natural resource agencies, the absence of historic properties identified at the site and public input the agency has determined that the proposal will not have a significant effect on the human environment and for which an Environment Impact Statement will not be prepared. The basis of this determination is a finding that the proposed plant development would not increase the water surface elevation of the base floodplain by more than a foot at any point within the community, utilizing an approach that is consistent with both the FEMA 8 Step Process and the relevant sections of FEMA Title 44 CFR 60.3(c), planned utilization of construction Best Management Practices, and implementation of a Storm Water Management Plan.
In order to avoid or minimize any adverse environmental impacts, the Rural Utilities Service will require the applicant to incorporate the following mitigation measures into the proposal’s design:
1. If construction occurs during the breeding bird season, clearance surveys are recommended approximately seven (7) days prior to implementation to minimize any potential impacts to MBTA species.
2. Utilization of construction Best Management Practices, to include but not limited to: suppression of dust from construction related activities; re-vegetation of areas disturbed by construction activities; and limiting construction noise pollution to daylight hours.
3. Implementation of a Storm Water Management Plan.
