NOTICE OF PROPOSED MINOR

SOURCE PROGRAM

AND REQUEST FOR COMMENTS

The Southern Ute Indian Tribe/State of Colorado Environmental Commission is seeking comments from interested persons on a proposed Minor Source Program, that is, an air pollution control program that will be applicable to sources of air pollution located within the exterior boundaries of the Southern Ute Indian Reservation that emit or have the potential to emit regulated air pollutants in amounts that are less than the major stationary source levels set by federal law and that are greater than the minor source thresholds set forth in the proposed program.

I. Statement of time, place and nature of rule-making proceeding.

In addition to receiving written comments as provided below, the Environmental Commission will hold a public hearing at the Sky Ute Casino & Resort, John S. Williams and Vida Peabody Rooms, 14324 US Hwy 172 North, Ignacio, Colorado, on Wednesday, July 21, 2010, beginning at 4:00 p.m., to receive public comment on the proposed program.

II. Legal authority under which the rule is proposed.

Legal authority is vested in the Southern Ute Indian Tribe/State of Colorado Environmental Commission by the Intergovernmental Agreement Between the Southern Ute Indian Tribe and the State of Colorado Concerning Air Quality Control on the Southern Ute Indian Reservation dated December 13, 1999 (“IGA”), tribal law (Resolution of the Council of the Southern Ute Indian Tribe # 00-09), State law (C.R.S. § 24-62-101), and federal law (Act of October 18, 2004, Pub. L. No. 108-336, 118 Stat.1354) to adopt rules and regulations for air quality programs applicable to all lands within the exterior boundaries of the Southern Ute Indian Reservation.

III. Deadline for submission of written comments.

IV. Summary description of proposed program.

The purpose of the Program is to establish a permitting and reporting program for existing minor sources and a preconstruction permitting and reporting program for new and modified minor sources located within the exterior boundaries of the Reservation. The program authorizes the imposition of emission limits and controls for those sources. The Program also provides a mechanism for an otherwise major stationary source to voluntarily accept restrictions on its potential to emit to become a synthetic minor source.

Minor source permits will include emission limitations, and monitoring, recordkeeping, reporting, and testing requirements to assure compliance with the emission limitations. Unless otherwise specified in the permit, compliance by existing sources must be achieved within three years from the date of permit issuance.

To determine the appropriate level of control and the corresponding emission limitations, the Tribe will require owners/operators to submit a best available control technology proposal for review by the Tribe on a case-by-case basis. In lieu of case-by-case control technology review, the required level of control and corresponding emission limitations may, in the Tribe’s discretion, be set forth in a general permit that may be established for various categories of similar sources with similar control technologies and capabilities. A draft General Permit to Construct/Operate Oil and Gas Minor Sources Located on the Southern Ute Indian Reservation is being proposed by the Southern Ute Indian Tribe for public review and comment concurrently with the Environmental Commission’s proposal of the Minor Source Program.

Pursuant to the Program regulations, emission sources will be charged an application or registration fee as well as an annual emissions fee for releasing air pollutants into the Reservation air-shed. Fees will be used to fund administration of the Program and allow for the development of other necessary regulations.

The Tribe and the Environmental Commission will enforce civil compliance with the Program. Appealable administrative actions taken by the Tribe will be subject to review by the Commission in accordance with the administrative appeal procedures contained in the Commission’s Procedural Rules.

ORDINANCE NO. 753, AN ORDINANCE GRANTING A FRANCHISE TO WASTE MANAGEMENT OF FOUR CORNERS, A DIVISION OF WASTE MANAGEMENT OF NEW MEXICO INC., TO OPERATE A REFUSE COLLECTION SERVICE IN THE TOWN OF PAGOSA SPRINGS, COLORADO, AND TO USE THE STREETS AND ALLEYS OF THE TOWN FOR SUCH PURPOSE AND SETTING FORTH CONDITIONS ACCOMPANYING THE GRANTING OF THIS FRANCHISE. OPPORTUNITY TO COMMENT

San Juan National Forest

Pagosa Ranger District

Archuleta, Conejos, Hinsdale, Mineral and Rio Grande Counties, Colorado

The Pagosa District, San Juan National Forest, has prepared a draft Environmental Assessment (EA) for the Pagosa Sheep Grazing Analysis, and is seeking public comment on the project. The project area encompasses approximately 216,400 acres of National Forest System Lands around Pagosa Springs, Colorado. The proposed action is to close 10 currently vacant domestic sheep allotments to grazing (Beaver-Rainbow, Deadman Turkey, First Fork, Fish Lake, Needles, Oil Mountain, Red Mountain, Saddle Mountain, Sheep Mountain, and Weminuche Sheep), and designate 5 currently vacant allotments as forage reserves that would be available for stocking with domestic sheep (Bonito Crater, Middle Fork Sheep, Peak, Treasure and Sand Creek/Summit). In addition, the proposed action would establish an adaptive process that would be implemented in the event these five allotments are stocked, which will help meet or move resource conditions towards desired conditions, and be consistent with Forest Plan objectives, Standards and Guidelines, and other legal requirements. Design criteria would also be applied to address specific issues. The analysis area is located north and east of Pagosa Springs, Colorado in portions of Townships 33-39 North, Ranges 1-3 East and Ranges 1-5 West, N.M.P.M. A majority of the analysis area is in the Weminuche and South San Juan Wilderness Areas.

How to Comment and Timeframe

Written, facsimile, hand-delivered, oral, and electronic comments concerning this action will be accepted for 30 calendar days following the publication of this notice in the Pagosa Sun. The publication date in the Pagosa Sun is the exclusive means for calculating the comment period for this analysis. Those wishing to comment should not rely upon dates or timeframe information provided by any other source. To be eligible to appeal the subsequent decision on this project, an individual or group must provide comment or otherwise express interest (36 CFR 215.11 (pre-2003 regulations)) in the proposed action during the comment period. The regulations prohibit extending the length of the comment period.

The office business hours for those submitting hand-delivered comments are 8:00 am – 4:30 pm, Monday through Friday, excluding holidays. It is the responsibility of persons providing comments to submit them by the close of the comment period. Only those who submit timely comments will have eligibility to appeal the subsequent decision. Individuals and organizations wishing to be eligible to appeal must meet the information requirements of 36 CFR 215.6.

Bids shall be presented in the form of a total Base Bid proposal under a Lump Sum Contract plus any additive or deductive alternates that are selected by the Owner. A bid must be submitted on all bid items and alternates; segregated bids will not be accepted. Plans and specifications are available from the Business Manager.

NOTE: Base Bid price shall not include state gross receipts or local options taxes. Taxes will be included in the Contracted Amount at prevailing rates as a separate item to be paid by Owner.

In submitting this bid, each Bidder must satisfy all terms and conditions of the Bidding Documents.

All work covered by this Invitation to Bid shall be in accordance with applicable state laws and, if bid amount is $60,000 or more, is subject to the minimum wage rate determination issued by the office of the Labor Commissioner for this project. If the bid amount of the contractor or any subcontractor exceeds $50,000, the contractor and/or subcontractor must comply with the registration requirements pursuant to the Public Works Minimum Wage Act.

Bid Security, if bid greater than $25,000, in the form of a surety bond executed by a surety company authorized to do business in the State of New Mexico in the amount of 5% of the total bid, or the equivalent in cash by means of a cashier’s check or in a form satisfactory to the Owner, must accompany each bid in accordance with the Instructions to Bidders.

A 100% Performance Bond and a 100% Payment and Materials Bond executed by a surety company authorized to do business in the State of New Mexico shall be required from the successful Bidder prior to award of contract.

A completed Subcontractor Listing Form must accompany each bid.

Each subcontractor shall provide a performance and payment bond on a public works building project if the subcontractor’s contract (to the Contractor) for work to be performed on a project is one hundred twenty-five thousand dollars ($125,000) or more. Failure of a Subcontractor to provide required bond shall not subject the Owner to any increase in cost due to approved substitution of Subcontractor.

The Bidding Documents contain a time for completion of the work and further impose liquidated damages for failure to complete the work within that time period.

No Bidder may withdraw his bid for 45 days after the actual date of the opening thereof.

The Owner intends to award this Project to the lowest responsible Bidder. The Owner reserves the right to reject any and all bids, to waive technical irregularities, and to award the contract to the Bidder whose bid it deems to be in the best interest of the Owner.

Attention of the Bidder is particularly directed to the current requirements as to Resident Contractor’s Preference per Section 13-4-3 NMSA 1978. The provisions of Sections 13-4-1 through 13-4-4 NMSA 1978 are not applicable to projects receiving Federal aid or when the expenditure of Federal funds designated for a specific contract is involved.

Requests for approval of substitutions for “or equal” material or equipment, if allowed by the contract documents, must includes a detailed itemized comparison of the proposed substitution with the specified product and be submitted at least 10 days prior to the bid date in accordance with Paragraph 3.3 of the Instructions to Bidders.
