COUNTY OF ARCHULETA, COLORADO

REQUEST FOR PROPOSAL FOR A 5-YEAR ROAD PLAN

NOTICE IS HEREBY GIVEN THAT THE County of Archuleta, Public Works Department, is requesting a Technical Proposal to provide a 5-Year Road Plan. Services will include, but not limited to, an analysis of existing road conditions, develop alternatives for road maintenance and repair, review of County road classification system, and provide a 5-year plan for roadway maintenance.

Technical Proposals will be received until 3:00 pm, June 5, 2010 by the Procurement Officer, at 449 San Juan Street, Pagosa Springs, Colorado, 81147. Proposals received after that time will not be considered and will be returned without opening to the submitter. All submittals shall be clearly marked “PROPOSAL FOR 5-YEAR ROAD PLAN”.

A pre-proposal meeting will be held at the Public Works Department, 1122 Hwy 84 South, Pagosa Springs, Colorado, 81147, on May 28, 2010, at 10:00am.

A selection panel will review and rank the Proposals. It is anticipated up to three firms may be selected for a presentation/interview prior to the final selection. Final selection will be made by June, 2010.

Interested parties must obtain a Request for Proposal (RFP) prior to submitting a proposal. The RFP will describe the submittal requirements, the selection process and basis for selection, and a Scope of Work. Request for Proposal documents may be accessed through the County of Archuleta website at www.archuletacounty.org. The County of Archuleta reserves the right to reject any Proposals and/or to waive any informality related to this solicitation.

PUBLIC NOTICE

Thomas H. Smith, whose address and phone number is 1701 E. 147th Street, Kansas City, MO 64146, 816-331-0435 has filed an application for a Regular (112) Construction Materials Operation Reclamation Permit with the Colorado Mined Land Reclamation Board under provisions of the Colorado Land Reclamation Act for the Extraction of Construction Materials. The proposed mine is known as the Eagle Mountain Pit, and is located at or near the Southwest Quarter of Section 4, Township 35 North, Range 2 West, New Mexico Principal Meridian.

The proposed Date of commencement is July 28, 2010, and the proposed date of completion is July 28, 2030. The proposed future use of the land is Range Land. Please note that under the provision of C.R.S. 34-32.5-101 et seq. Comments related to noise, truck traffic, hours of operation, visual impacts, effects on property values and other social or economic concerns are issues not subject to this Office’s jurisdiction. These subjects, and similar ones, are typically addressed by your local governments, rather than the Division of Reclamation, Mining, and Safety or the Mined Land Reclamation Board.

This is to advise you that the above-captioned action is pending. A Judgment and Decree for Judicial Foreclosure has been entered in this action concerning an assessment lien by the plaintiff Mountain Meadows Property Owners Association, Inc. pursuant to the Colorado Common Interest Ownership Act, Colorado Revised Statutes, §3-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Mountain Meadows Property Owners Association, Inc. of (said) Assessment Lien being recorded on September 9, 2008 at Reception No. 20806995, released on November 16, 2009, recorded at Reception No. 20909581, corrected and re-recorded on December 2, 2009 at Reception No. 20909582, in the office of the Clerk and Recorders Office of Archuleta County, Colorado (the “Assessment Lien”).

The real property which is the subject matter of this litigation, which is the property subject to the Assessment Lien, is situation in Archuleta County, and is described as follows, to-wit:

One White Unit Week as said week is defined in the Declaration of Interval Ownership for Mountain Meadows recorded under Reception #137132, and amendments and supplements thereto, in Building Number 1 of Mountain Meadows-Phase One as described and delineated on that Plat captioned “Mountain Meadows – Phase One” filed for record under Reception #137131.

Together with a right of ingress and egress over the existing road to Lakeside Drive.

The Plaintiff named above is the judgment creditor in this action and the lienor of the property pursuant to the Colorado Common Interest Ownership Act, Colorado revised Statutes, §33-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Mountain Meadows Property Owners Association. As of March 1, 2010, the outstanding balance due and owing on such judgment is $4,229.90.

I shall offer for public sale to the highest bidder, for case, at public auction, all the right, title and interest of the defendants in said property on July 14th, 2010 at 10:00 a.m. at the Archuleta County Sheriff’s Office, 449 San Juan St., Pagosa Springs, CO 81147.
