PUBLIC NOTICE

Keyah Grande LLC; 13211 Highway 160 West, Pagosa Springs, CO 81147, (970) 731-2158, has filed an application for a Regular (112) Construction Materials Operation Reclamation Permit with the Colorado Mined Land Reclamation Board under provisions of the Colorado Land Reclamation Act for the Extraction of Construction Materials. The proposed mine is known as the Keyah Grande Gravel Pit, and is located at or near Section 5, 6, 7 & 8, Township 36 North , Range 9 West, New Mexico Prime Meridian.

The proposed date of commencement is June 15, 2010, and the proposed date of completion is September, 2012. The proposed future use of the land is wildlife habitat preservation. INVITATION TO BID

Separate sealed BIDS for the 2010 Resurfacing of Aspenglow Blvd., Handicap Ave., and Carlee Place will be received by Archuleta County at the Archuleta County Courthouse, Commissioner’s Room located at 449 San Juan Street, P.O. Box 1507, Pagosa Springs, Colorado, until 2:00 P.M. local time on APRIL 29, 2010, and then at said office publicly opened and read aloud.

The base project consists of reconstructing Aspenglow Boulevard from Piedra Road to Nocturn Drive and Handicap Avenue from Piedra Road to Pines Club Place. A potential addition the to project includes Pines Club Place from Handicap Avenue to Carlee Place and Carlee Place from Pinion Causeway to Park Avenue. The project includes: traffic control, milling the existing asphalt, excavating and reconstructing unstable sections of road, installing culverts, shaping ditches, placing geo-textile fabric, placing aggregate base course, and hot bituminous paving. The base project is approximately 1.7 miles in length, with the potential addition being nearly 0.3 miles long, for an overall possible total of 2.0 miles.

Archuleta County, at the discretion of the Board of County Commissioners, has the ability to apply up to a 2% local preference cost allowance in selecting the qualified Contractor.

NOTICE OF PROPOSED CHANGES TO RESERVATION AIR CODE AND TITLE V OPERATING PERMIT PROGRAM AND REQUEST FOR COMMENTS

The Southern Ute Indian Tribe/State of Colorado Environmental Commission is seeking comments from interested persons on certain changes to the Commission’s Reservation Air Code including the Commission’s Title V operating permit program (“Code”) under the federal Clean Air Act. The changes are those required by the United States Environmental Protection Agency as a condition to EPA’s approval of the Application for Approval of the Southern Ute Indian Tribe’s 40 CFR Part 70 Operating Permit Program, as well as changes recommended by EPA.

I. Statement of time, place and nature of rule-making proceeding.

In addition to receiving written comments as provided below, the Environmental Commission will hold a public hearing at the Durango Community Recreation Center, Windom Meeting Room, 2700 Main Avenue, Durango, Colorado on Monday, May 10, 2010, beginning at 5:30 p.m., to receive public comment on the proposed changes.

II. Legal authority under which the rule is proposed.

Legal authority is vested in the Southern Ute Indian Tribe/State of Colorado Environmental Commission by the Intergovernmental Agreement Between the Southern Ute Indian Tribe and the State of Colorado Concerning Air Quality Control on the Southern Ute Indian Reservation dated December 13, 1999 (“IGA”), tribal law (Resolution of the Council of the Southern Ute Indian Tribe # 00-09), State law (C.R.S. § 24-62-101), and federal law (Act of October 18, 2004, Pub. L. No. 108-336, 118 Stat.1354) to adopt rules and regulations for air quality programs applicable to all lands within the exterior boundaries of the Southern Ute Indian Reservation.

III. Deadline for submission of written comments.

IV. Summary description of proposed Code changes.

The Code was adopted by the Commission on November 12, 2008, and incorporated into the Application for Approval of the Southern Ute Indian Tribe’s 40 CFR Part 70 Operating Permit Program, which was submitted by the Tribe to the EPA in January 2009. In a recent letter, EPA has expressed its intent to approve the Tribe’s Part 70 Program Application, contingent on certain required changes to the Code. EPA also recommends several changes aimed at strengthening the Code.

A. Summary of Required Changes.

EPA’s required changes can be categorized as follows:

1. Modification of Provisions to Satisfy 40 CFR Part 70 Requirements. Most of EPA’s required changes involve either the addition of sentences, phrases, or clauses or the deletion of certain words or phrases in order to make the provisions more closely conform to the wording used in 40 CFR Part 70. The required modifications usually result in the Code provisions exactly matching the corresponding provisions in 40 CFR Part 70.

2. Additional Defined Terms. The following are among the additional defined terms required by EPA:

• “Applicable requirement”

• “Designated representative”

• “Part 70 program”

3. Federal Processes. In several instances, EPA is requiring the Code to include provisions found in 40 CFR Part 70 that authorize certain EPA processes, such as those used by EPA to reopen permits for cause and object to tribal-issued permits.

4. Acid Rain Provisions. Included among the required changes are certain provisions that refer to aspects of the acid rain regulations promulgated under title IV of the Clean Air Act.

B. Summary of Recommended Changes.

EPA’s recommended changes include the addition of “alternative operating scenario (AOS)” and “approved replicable methodology (ARM)” as defined terms. The other recommended changes involve modifications to ensure that the Code provisions are worded exactly like the corresponding provisions in 40 CFR Part 70.

NOTICE OF HEARING

TO ALL INTERESTED PARTIES AND TO WHOM IT MAY CONCERN:

Pursuant to C.R.S. §34-60-116(1) through (5), the Colorado Oil and Gas Conservation Commission (“Commission”) has the authority to establish drilling and spacing units (“drilling units”) to prevent or assist in preventing waste, to avoid the drilling of unnecessary wells, or to protect correlative rights. When two or more separately owned tracts are embraced within a drilling unit, or when there are separately owned interests in all or a part of the drilling unit the persons owning such interests may pool their interests for the development and operation of the drilling unit. §34-60-116(6), C.R.S. (2009). In the absence of voluntary pooling, the Commission, upon the application of any interested person, may enter an order pooling all interests in the drilling unit for the development and operation of the drilling unit.

Effective June 15, 1988, the Commission issued Order No. 112-60 which established 320-acre drilling units for the production of gas and associated hydrocarbons from the Fruitland coal seams, underlying certain lands in the Ignacio-Blanco Field, with the permitted well when South of the Ute Line to be located in the NE¼ and the SW¼ of each section and when North of the Ute Line to be located in the NW¼ and SE¼ of each section, no closer than 990 feet from the boundaries of the quarter section, nor closer than 130 feet to any interior quarter section line. Order Nos. 112-61 and 112-85 were subsequently adopted amending Order No. 112-60 to establish additional field rules for the Fruitland coal seams. The following lands (“Application Lands”) are subject to these orders:

Township 32 North, Range 6 West, N.M.P.M.

Effective February 12, 2002, the Commission entered Order No. 112-162, which pooled the Application Lands for the development and operation of the Fruitland coal seams.

Effective July 23, 2007, the Commission entered Order No. 112-204, which authorized the optional drilling of two additional Fruitland Coal seam wells on the Application Lands.

On February 3, 2010, Willard Seibel, trustee of the Willard H. Seibel Revocable Trust, and Betty Seibel, trustee of the Betty Seibel Revocable Trust, (“Seibels”), by their attorney, filed with the Commission a verified application for an order to declare that Order No. 112-62, by its terms, force pooled the Seibels’ unleased mineral interest in the pooled drilling unit only as to the Swanemyr #32-6-1 Well. Alternatively, the Seibels seek a declaration that the Commission lacked the authority to force pool the Seibels’ unleased mineral interests for more than one well at a time absent compliance by the force pooling applicant with all conditions precedent to force pooling, specifically, an offer to bear their proportionate share of the costs and risks of drilling and operating each additional well in the drilling and unit.

During the period of cost recovery provided by (7) of C.R.S. §34-60-116, the Commission retains jurisdiction to determine the reasonableness of costs of well operations attributable to the interest of a nonconsenting owner. Seibels may request an accounting of the costs associated with one or more wells drilled on the Application Lands.

In accordance with the practices of the Commission, should no protests or interventions be filed in this matter by April 15, 2010, the Applicant may request that an administrative hearing be scheduled during the week of April 19, 2010. In the alternative, pursuant to Rule 511., if the matter is uncontested, the applicant may request, and the Director may recommend approval on the basis of the merits of the verified application and the supporting exhibits.

This is to advise you that the above-captioned action is pending. A Judgment and Decree for Judicial Foreclosure has been entered in this action concerning an assessment lien by the plaintiff Eagle’s Loft Property Owners Association, Inc. pursuant to the Colorado Common Interest Ownership Act, Colorado Revised Statutes, §3-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Eagle’s Loft Property Owners Association, Inc. of (said) Assessment Lien being recorded on September 8, 2009 at Reception No. 20906874, in the office of the Clerk and Recorders Office of Archuleta County, Colorado (the “Assessment Lien”).

The real property which is the subject matter of this litigation, which is the property subject to the Assessment Lien, is situation in Archuleta County, and is described as follows, to-wit:

Unit Number 47 Building Number 47, Unit Week Number 19, in “EAGLE’S LOFT – Phase IV, as Reception No. 137941 and in accordance with and as limited and defined by the Declaration of Individual and/or Interval Ownership, recorded under Reception Number 117700 in Book 200 at Page 834 et seq and amendments and supplements thereto in the Office of the County Clerk and Recorder in and for Archuleta County, Colorado.

The Plaintiff named above is the judgment creditor in this action and the lienor of the property pursuant to the Colorado Common Interest Ownership Act, Colorado revised Statutes, §33-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Eagles’ Loft Property Owners Association.
