Town prematurely publishes three legal notices

As a result of Tuesday’s decision by the Town’s board, three notices in this week’s edition of The SUN have been rendered irrelevant.

• A notice for a public hearing regarding Emergency Ordinance 751, to be held at noon, Monday, March 15. Due to council’s decision on Tuesday, no hearing will be held.

• A notice regarding passage of Emergency Ordinance 751 on first reading. In fact, Emergency Ordinance 751 was not passed.

• A notice regarding passage of Ordinance 751 on second reading. Again, the ordinance was never passed.

According to Pagosa Springs Town Manager David Mitchem, the notices were submitted to The SUN early, adding “In an effort to be more efficient, we were a bit premature in posting these notices.”

Mitchem said that, due to time constraints with the April 6 election, town staff felt it would be prudent to post the notices prior to council decisions in order to meet statutory requirements (as stipulated in the town’s charter). Mitchem also said that, “I regret any confusion these items may cause.”
