Notice of Intent to Request Release of Funds

This notice shall satisfy procedural requirements for activities to be undertaken by Housing Solutions for the Southwest.

REQUEST FOR THE RELEASE OF FUNDS

On or about February 26 , 2010 San Juan County, grantee for the five county southwest region of Colorado, will submit a request to the Colorado Department of Local Affairs on behalf of Housing Solutions for the Southwest for the release of CDBG funds under funds, under Title I of the Housing and Community Development Act of 1974, as amended or Title II of the Cranston-Gonzalez National Affordable Housing Act, to undertake a project known as Single Family Owner Occupied Rehabilitation, for the purpose of rehabilitation of low-to-moderate single family homes and emergency repairs in the five county region, estimated funding of $300,794.

Each jurisdiction (county) in the region must prepare an environmental review. An environmental review for the project has been made by Archuleta County and is available for public examination and copying at the offices noted below. Based on this review, Archuleta County has determined that a request for release of funds will not significantly affect the quality of the human environment and hence, an environmental impact statement will not be undertaken under the National Environmental Policy Act of 1969 (P.L. 91-190). Additional project information is contained in the Environmental Review Record (ERR) on file at Archuleta County Courthouse, Commissioners Office, 449 San Juan St., Pagosa Springs, CO, 81147 and may be examined or copied weekdays 8am to 5pm.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Housing Solutions for the Southwest, 295 Girard St. Durango, CO, 81301. All comments received by February 19, 2010 will be considered by Archuleta County prior to authorization of the submission of a request for release of funds by San Juan County.

RELEASE OF FUNDS

Archuleta County certifies to the Colorado Department of Local Affairs that Gregory Shulte in his capacity as County Administrator consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Colorado Department of Local Affairs’ approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Housing Solutions for the Southwest to use Program funds.

OBJECTIONS TO THE RELEASE OF FUNDS

The Colorado Department of Local Affairs will accept objections to its release of funds and Archuleta County’s certification for a period of 15 days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of Archuleta County (b) Archuleta County has omitted a step or failed to make a decision or finding required by U.S. Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by the Colorado Department of Local Affairs; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58 and shall be addressed to the Colorado Department of Local Affairs, Environmental Compliance Officer, 1313 Sherman St., Room 521, Denver, CO 80203. No objections received after 15 days from the date of request for release of funds will be considered by the state.
