NOTICE OF ACCEPTANCE OF APPLICATIONS TO SERVE AS DIRECTORS OF SAN JUAN WATER CONSERVANCY DISTRICT

TO WHOM IT MAY CONCERN, and particularly to the property owners within San Juan Water Conservancy District of Archuleta County, Colorado.

NOTICE IS HEREBY GIVEN that on March 21, 2010, the terms of office of three (3) Directors of the San Juan Water Conservancy District shall expire. Applications for appointment to the Board of Directors of the District will be received until February 19, 2010, for such positions.

To be considered, you must have resided within the District for one year, must be the owner of real property within the District in Archuleta County, and must be knowledgeable in water matters. Applications are being received for the positions on an at-large basis that will generally achieve a geographical representation of the District, in accordance with Section 37-45-114, C.R.S.

PUBLIC NOTICE

The Town of Pagosa Springs Planning Commission will hold a public hearing to review a request to rezone 1100 CR 500, Burnett Subdivision 2 Lot 2a.

Currently zoned as R-T (Rural transitional) requesting to rezone as R-12 (Residential 12 units per acre). The public hearing is scheduled for 5:00 p.m. on February 9, 2010, to be held at Town Hall at 551 Hot Springs Boulevard. Anyone wishing to comment should contact the Town Planning Department or attend the public hearing and be heard.

PUBLIC NOTICE

NOTICE OF PUBLIC HEARING

The Pagosa Springs Town Clerk will hold a public hearing on Monday February 1, 2010 at 10:00 a.m. in the Town Hall Council Chambers to consider comments from the public and thereafter set the ballot title concerning the referred Ordinance No. 743, AN ORDINANCE OF THE TOWN OF PAGOSA SPRINGS REPEALING AND RE-ADOPTING SECTION 2.4.5 OF THE LAND USE AND DEVELOPMENT CODE AND THE LARGE RETAIL DEVELOPMENT PERMITS SECTION OF THE LAND USE AND DEVELOPMENT CODE USER’S MANUAL. All people wishing to comment should be present at that meeting or file written comments in the office of the Town Clerk no later than 12:00 p.m. on Friday January 29, 2010.

A Conditional Use Permit on a portion of 465 acres is proposed in the NW quarter of the SW quarter of Section 16, Township 33N, Range 5W, N.M.P.M. The proposal is for a 6.4 acre major gravel extraction operation on the property. The property also known as the Tierra Piedra Ranch, is located at 11501-A-5 State Highway 151, and the property is adjacent to the intersection of County Road 193 and Highways 151.

SHERIFF’S COMBINED NOTICE OF SALE, RIGHT TO CURE AND RIGHT TO REDEEM

TO WHOM IT MAY CONCERN:

This is to advise you that the above-captioned action is pending. A Judgment and Decree for Judicial Foreclosure has been entered in this action concerning an assessment lien by the plaintiff Eagle’s Loft Property Owners Association, Inc. pursuant to the Colorado Common Interest Ownership Act, Colorado Revised Statutes, §3-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Eagle’s Loft Property Owners Association, Inc. of (said) Assessment Lien being recorded on August 27, 2008 at Reception No. 20806794, in the office of the Clerk and Recorders Office of Archuleta County, Colorado (the “Assessment Lien”).

The real property which is the subject matter of this litigation, which is the property subject to the Assessment Lien, is situation in Archuleta County, and is described as follows, to-wit:

Unit Number 49 Building Number 49, Unit Week Number 43, in “EAGLE’S LOFT – Phase IV, as Reception No. 137941 and in accordance with and as limited and defined by the Declaration of Individual and/or Interval Ownership, recorded under Reception Number 117700 in Book 200 at Page 834 et seq and amendments and supplements thereto in the Office of the County Clerk and Recorder in and for Archuleta County, Colorado.

The Plaintiff named above is the judgment creditor in this action and the lienor of the property pursuant to the Colorado Common Interest Ownership Act, Colorado revised Statutes, §33-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Eagles’ Loft Property Owners Association. As of December 1, 2009, the outstanding balance due and owing on such judgment is $4,112.05.

I shall offer for public sale to the highest bidder, for case, at public auction, all the right, title and interest of the defendants in said property on March 24, 2010 at 10:00 a.m. at the Archuleta County Sheriff’s Office, 449 San Juan St., Pagosa Springs, CO 81147.

NOTE: THE LIEN BEING FORECLOSED MAY NOT BE A FIRST LIEN.
