The proposed mine is known as the Tierra Piedra Gravel Pit, and is located at or near Section 16, Township 33 North, Range 5 West, N.M.P.M.

The proposed date of commencement is May, 2010, and the proposed date of completion is November, 2014. The proposed future use of the land is a pond for wildlife habitat.

No change in use is sought for the Muddy Creek Reservoir water right. Applicant is requesting an alternate point of diversion for the Muddy Creek Ditch because its source, Big Muddy Creek, is prone to extreme flash flooding. Such flooding has resulted in numerous channel changes and has periodically destroyed the headgate and portions of the ditch. The requested alternate point of diversion will provide for more practical diversion and use of this absolute water right. The requested alternate point of diversion is on the Navajo River below the confluence of Big Muddy Creek and the Navajo River and will thereby reduce the depletive reach in Big Muddy Creek and the Navajo River. The historical place of use of the Muddy Creek Ditch water right has been for storage in Muddy Creek Reservoir for subsequent decreed use under the Muddy Creek Reservoir water right and is generally depicted on the topographic map attached as Exhibit A to the Application as those lands lying in below and surrounding the Muddy Creek Reservoir dam. The Muddy Creek Reservoir is also depicted on Exhibit A. No change in place of use is sought in this application and all water diverted under the Muddy Creek Ditch water right will continue to be used to fill the Muddy Creek Reservoir water storage right. No change in use for the Muddy Creek Reservoir water right is requested in this Application. Diversion records for the Muddy Creek Ditch water right are provided as Exhibit B to the Application. (b) Location of Alternate Point of Diversion: The alternate point of diversion is located on the Navajo River in the NE¼ of the SW¼ of Section 13, Township 33 North, Range 2 East, N.M.P.M. at a point 1,978 feet from the South section line and 2,699 feet from the West section line. This location is also described by the following GPS position: 4106923°52’1.66” Easting and 350050°44’32.96” (averaged). This map also depicts the historical place of use of the Muddy Creek Ditch water right, which has been within the ditch itself and in Muddy Creek Reservoir (for fish culture), as a source of fill for Muddy Creek Reservoir, and for limited irrigation of the area immediately below the Muddy Creek Reservoir dam. (c) Proposed Plan for Operation: Water historically diverted at the headgate on Big Muddy Creek will now be diverted downstream below the confluence of Big Muddy Creek and the Navajo River from a headgate located on the Navajo River. This will result in increased flows in Big Muddy Creek below the original point of diversion and increased flows in that segment of the Navajo River below the confluence with Big Muddy Creek to the alternate point of diversion. Diversions will be limited to the such quantities legally and physically available at the original point of diversion. Crop Irrigation Requirements. A 1970 through 2006 (37-year) historical research period (Analysis Period) was analyzed to estimate the historical consumptive use of the Tribe’s Lake Capote storage right based on crop irrigation requirements for the Dry-Up Acreage. Irrigation demand was based on the climatic conditions at the nearby NOAA Pagosa Springs climate station (1906 to 1998) combined with the Pagosa Springs 4 NW climate station (1999 to 2009). Monthly crop irrigation water requirements were estimated using the Modified Blaney-Criddle method outlined in Irrigation Water Requirements Technical Release No. 21 (TR-21). Per the Colorado State Engineer’s Office, ASCE Manuals and Reports on Engineering Practice No. 70, Evapotranspiration and Irrigation Water Requirements, a standard elevation adjustment was applied to the TR-21 alfalfa crop coefficients. The average annual crop irrigation requirement, representing what a crop needs from an irrigation source (potential evapotranspiration less precipitation effective in meeting crop needs) for the Analysis Period was calculated as 1.89 AF per acre. The annual climate-based crop irrigation water requirement ranges from 1.43 to 2.52 AF per acre, as shown graphically in Figure 1 on page 6 of the Engineering Report. Lake Capote Water Supply. The reserved water right for Lake Capote allows for irrigation of 600 acres. Based on 1,850 acre-feet of storage, the Lake Capote water supply is 3.08 acre-feet per acre. Per the Piedra River Consent Decree, the reservoir can be expanded from its current 654 acre-feet of storage capacity to the 1,850 acre-feet decreed amount. Based on the current operational storage volume of 380 acre-feet, 124 acres can be supplied with a full allocation. Lake Capote Water Available to Dry-Up Acreage. Based on the location of the Dry-Up Acreage with respect to a likely river headgate, a 90 percent ditch efficiency was used to determine the amount of reservoir water that is available to the Dry-up Acreage. An 80 percent application efficiency was used to represent sprinkler irrigation practices. In a full-allocation year, 72 percent (90 percent ditch efficiency times 80 percent application efficiency) of the 3.08 annual AF per acre allocation is available to meet the annual crop irrigation requirement, or 2.22 acre-feet per acre per year. Historical Beneficial Use of Lake Capote Water For The Dry-Up Acreage. The annual Lake Capote supply available to the Dry-Up Acreage was compared to the annual crop irrigation requirement for the Analysis Period. The minimum of the two values is the estimated historical crop consumptive use from Lake Capote storage. The annual crop consumptive use for the Analysis Period is 1.87 AF per acre. Note that because the only water supply for the Dry-Up Acreage is from reservoir storage, it is sufficient to perform this comparison on an annual basis instead of a monthly basis since water is available from Lake Capote whenever the Tribe requests releases of its reservoir storage. Historical Return Flows. The Dry-Up Acreage has not historically received water. Therefore, other water users have not benefitted from historical return flows associated with irrigation of this acreage. The annual non-consumptive portion of the Lake Capote allocation for the Dry-Up Acreage will remain in the reservoir, thereby mimicking historical practices. Change of Use. The Tribe’s changed reservoir water will be allocated by the Lake Capote operator to the changed demand in a manner consistent with historical practices as defined in the Piedra River Consent Agreement. The Tribe’s changed storage water will be released when needed for changed uses throughout the year. (19 pages)
